Smoke-free workplaces Summer 2007
Is your company ready for the ban on smoking in workplaces which comes into effect on 1st July 2007?
Companies need to develop a Smoking Policy in consultation with employees, publicising the company’s approach. The No Smoking ban will apply to all persons, whether employees, contractors, visitors or clients, and all enclosed or substantially enclosed buildings. This is likely to include undercroft areas, and outbuildings.
If companies are providing smoking shelters they must make sure they are not substantially enclosed, nor that they are sited too close to the building and become part of the structure, thereby needing to be smoke free. Look carefully at any such design as many of these shelters have been classed as being substantially enclosed.
It will also apply to all company vehicles unless only ever used by one person with no passengers. It should therefore also apply to any private vehicles driven on company business when shared with another occupant travelling on behalf of the Company. Private dwellings used for work by the person living in the dwelling are exempt, unless they share the workspace with anyone else, which would include other employees visiting the homeworker in their home. It does not, however, cover employees visiting ‘people’ in their own home, ie members of the public.
No smoking signs will need to be displayed on entrances to smoke-free premises and vehicles.
