Non-employee workers new PPE Requirements

Changes to the Provision of Protective Equipment Regulations coming into effect on 6th April 2022
· Currently employers only have to supply their own employees with necessary PPE to ensure safe working and ensure they receive the appropriate training
· New PPER 2022 will extend this duty to non-employee persons defined as ‘workers’
· ‘Workers’ in this context are labour-only subcontractors such as are employed on building sites or in the gig industry, or workers employed on a casual or irregular basis but who are not self-employed or employees of another subcontracting company
· Employers will also have to provide these workers with suitable information and training regarding the use of PPE, and will have a duty to maintain and replace any such PPE
· These workers also have new legal duties under these regulations, to use the PPE provided which would imply that they could be individually prosecuted if they fail to do so
